What is TDS?
TDS (Tax Deducted at Source) is a tax collection method introduced by the Government of India to ensure tax is collected at the time of payment itself. In this process, the payer (deductor) deducts a certain percentage of the payment and deposits it with the government.
The deductor must also file a TDS Return – a quarterly statement providing details of payments made and TDS deducted.
Who is Required to File TDS Return?
You need to file TDS return if:
- You are a company, firm, LLP, or an individual required to deduct TDS.
- You have an employer–employee relationship and deduct TDS on salaries.
- You make payments such as rent, professional fees, contractor charges, commission, or interest that are subject to TDS.

Penalties for Late Filing of TDS Return
- Late filing fee (Section 234E): ₹200 per day until the return is filed, subject to the maximum TDS amount.
- Penalty (Section 271H): ₹10,000 to ₹1,00,000 if incorrect information is furnished or return is not filed at all.
- Interest on late deposit of TDS also applies.
